By checking the box at checkout or completing payment, you acknowledge that you have read and agree to these Terms & Conditions and authorize GoldReviews.ca to begin immediate setup and delivery of your selected marketing services. All services are digital in nature, and payments become final once processing begins.
Welcome to GoldReviews.ca (“GoldReviews,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at https://goldreviews.ca and any related features, applications, or services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Statement.
If you do not agree to these Terms, do not use the Services.
1) Eligibility & Business Use
You confirm that you are at least the age of majority in your province or territory (18 or 19 as applicable) and have authority to bind yourself or your organization. The Services are intended for business and commercial use.
2) Account Registration & Security
Some features may require an account. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for all activity under your account. Notify us promptly of any unauthorized access or use.
3) Permitted Use & License
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You may not copy, modify, reverse-engineer, scrape, frame, or otherwise exploit the Services except as expressly permitted.
4) Intellectual Property
All content and materials on the Services—including text, graphics, logos, icons, images, audio/video, data compilations, software, and the “GoldReviews” name and marks—are owned by or licensed to GoldReviews and protected by applicable intellectual-property laws. No rights are granted except as explicitly stated.
5) Privacy & CASL Consent
Your use of the Services is subject to our Privacy Statement. If you opt in, we may send you marketing communications in compliance with Canada’s Anti-Spam Legislation (CASL). You can withdraw consent at any time (e.g., “unsubscribe” in email or “STOP” via SMS).
6) Service Descriptions & Third-Party Tools
Service descriptions on the site are for general information and may change. We may integrate third-party tools (e.g., hosting, analytics, payment, CRM). Those providers are independent from us and subject to their own terms and privacy policies.
7) Subscriptions, Trials & Automatic Payments
Some Services are offered on a subscription basis (monthly unless stated otherwise).
Billing: Fees are billed in Canadian Dollars (CAD) plus applicable taxes.
Trials: If you receive a free trial and do not cancel before the trial ends, billing begins automatically on the stated plan.
Auto-Renewal: Subscriptions renew automatically until canceled. You authorize recurring charges to your payment method.
Price Changes: We may change prices on renewal with prior notice by email or posting on our site. New prices take effect on the next billing cycle.
Downgrades/Upgrades: Plan changes take effect on the next cycle unless otherwise specified.
8) Dominate Starter & Other Annual Service Plans
For one-year marketing service plans—including but not limited to Dominate Starter, Dominate 2026, and other managed programs—GoldReviews.ca provides done-for-you marketing automation and optimization services.
These include:
Billing: Fees are billed in Canadian Dollars (CAD) plus applicable taxes.
Trials: If you receive a free trial and do not cancel before the trial ends, billing begins automatically on the stated plan.
Auto-Renewal: Subscriptions renew automatically until canceled. You authorize recurring charges to your payment method.
Price Changes: We may change prices on renewal with prior notice by email or posting on our site. New prices take effect on the next billing cycle.
Downgrades/Upgrades: Plan changes take effect on the next cycle unless otherwise specified.
Fulfillment begins immediately after payment, as systems, automations, and digital assets are provisioned for your account. Because delivery begins right away and involves software setup and digital configuration, all payments are final and non-refundable once processing begins.
Plans renew automatically each year at the same rate unless canceled by written notice at least 7 days before renewal.
If you maintain continuous service, your current rate remains in effect unless otherwise notified in advance. Third-party usage fees (e.g., SMS, email, or call charges) are billed separately to the client.
9) Cancellations & Refunds
You may cancel monthly subscriptions effective at the end of the current billing period, or cancel renewal of annual plans by written notice at least 7 days before the renewal date.
Unless required by law, fees are non-refundable and non-creditable, including for partial months, unused time, or unused features. Because our services involve immediate setup and digital fulfillment, payments are final once processing begins.
10) Acceptable Use
You agree not to:
Use the Services unlawfully or to violate rights of others;
Upload or transmit malware or disrupt the Services;
Attempt to access non-public areas;
Misrepresent your identity or affiliation;
Use the Services to send unsolicited or unlawful communications.
11) Results Disclaimer
Every business is unique. GoldReviews.ca provides marketing support and automation tools but does not guarantee specific lead volume, rankings, reviews, or revenue outcomes. Any testimonials or case studies are illustrative only.
12) Your Responsibilities & Compliance
You are responsible for your content, campaigns, and compliance with all applicable laws and regulations (including privacy, advertising, consumer protection, CASL, competition, and record-keeping). You warrant that you have all necessary permissions to process personal information you provide to us or have us process on your behalf.
13) User Content & Feedback
If you submit content or feedback, you grant GoldReviews.ca a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display it for operating, improving, and promoting the Services. You represent that you own or control all rights to what you submit.
14) No Warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
15) Limitation of Liability
To the maximum extent permitted by law, GoldReviews.ca and its directors, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to the Services or these Terms, even if advised of the possibility. Our total liability for any claim will not exceed the fees you paid to us for the Services in the three (3) months preceding the event giving rise to liability.
16) Indemnity
You agree to defend, indemnify, and hold harmless GoldReviews.ca and its personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your content, your use of the Services, your breach of these Terms, or your violation of laws or third-party rights.
17) Suspension & Termination
We may suspend or terminate your access at any time if we believe you violated these Terms or pose a risk to the Services or others. You may stop using the Services at any time. Sections that by nature should survive (e.g., IP, disclaimers, limitations, indemnity, governing law) will survive termination.
Dispute Resolution: The parties will attempt to resolve any dispute in good faith within 30 days after written notice. Subject to applicable law, the parties submit to the exclusive jurisdiction of the courts of Ontario (Toronto).
Class actions are waived to the fullest extent permitted by law. The parties may mutually agree to binding arbitration under the ADRIC Arbitration Rules in Toronto.
18) Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
19) Force Majeure
We are not liable for delays or failures due to causes beyond our reasonable control (including acts of God, labour disputes, power or internet outages, or governmental actions).
20) Entire Agreement; Severability; Waiver
These Terms, together with our Privacy Statement, form the entire agreement between you and us regarding the Services and supersede all prior agreements. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any provision does not constitute a waiver.
